A 544 ACRE SUBDIVISION IN HUNT COUNTY
DEED RESTRICTIONS
1. All lots in this subdivision shall be used for single family residential purposes only.
2. Any one story residence constructed on the property shall have a ground floor area of not less than 1800 square feet (any two story residence constructed on property shall have a ground floor of not less than 1200 square feet), exclusive of garages, open porches, terraces, patios, driveways, or carports, and shall be completed within twelve (12) months from starting construction. All attached garages must be side or rear entry. From primary road, corner lots must have rear entry only.
3. At least fifty percent (50%) of the exposed exterior must be brick, stone, or masonry hardibacker construction, no vinyl or aluminum siding allowed.
4. All propane tanks must be behind primary structure and not visible from street or adjoining lots.
5. No structure shall be located within forty (40) feet of the street.
6. All electrical connections from the utility easements to the house must be underground.
7. All structures must be built parallel facing to a street.
8. No trade or business of any type shall be carried on upon any lot, nor shall anything be done on any lot which may be noxious or offensive or may become an annoyance or nuisance to the neighborhood.
9. Outbuildings (barns, stalls, tool sheds, antennas, and all other buildings) shall be limited to two (2) buildings and must be of new construction no larger than thirty (30) feet by forty (40) feet and fifteen (15) feet tall and must be located a minimum of seventy-five (75) feet behind the primary structure. The location of a well house may be placed adjacent to well.
10. The Deed Restrictions may be changed by American National Credit Corporation, until 70% of the lots and/or acreage has been sold by Southwest Kawasaki and/or American National Credit Corporation.
11. No structure of a temporary character (trailer, mobile home, basement, tent, shack, garage, or other outbuilding) shall be used on the property at any time as a residence, either temporarily or permanently; except for the sales trailer used by the developer.
12. No inoperative or unregistered motor vehicle(s) and/or machinery and/or equipment shall be kept on the property. No commercial vehicles Class 6 or above shall be stored or parked on the property. All tools, equipment, and material(s) shall be kept behind the primary structure in outbuildings. All vehicles must be parked on designated driveways. Recreation vehicles must be stored in an enclosure behind primary residence.
13. No move-in homes or move-in garages shall be placed on the property.
14. No swine shall be raised, bred, or kept on the property. Only one (1) farm/domesticated animal per acre is allowed. Only three (3) dogs allowed per dwelling. No commercial kennels are allowed. No fowl, domesticated, or wild animals are allowed. All animals must be leashed or kept in a fenced enclosure. All animals must be fenced behind primary structure.
15. No garbage shall be kept except in sanitary containers. No tract or part thereof shall be used or maintained as a dumping ground for rubbish or trash. The resident shall not burn household garbage or trash.
16. If sewage disposal is by means on-site sewage facilities, a permit must be obtained for each lot.
17. Septic tank performance cannot be guaranteed, even though all provisions of the Hunt County rules for private sewage facilities are complied with.
18. Inspection and/or acceptance of a private sewage facility by Hunt County shall indicate only that the facility meets the minimum requirements and does not relieve the property owner of the responsibility to comply with County, State, and Federal regulations.
19. On-site sewage facilities, although approved of meeting minimum standards, must be upgraded by the property owner at the property owner’s expense if the normal operation of the facility results in objectionable odors, if unsanitary conditions are created or if the facility, at any time, does comply with governmental regulations.
20. A properly designed and constructed on-site sewage facility, situated in suitable soil, my malfunction of the facility is not properly maintained and controlled. Therefore, it shall be the property owner’s responsibility to maintain and operate the on-site sewage facility in a satisfactory manner.
21. On-site sewage facilities must be designed in accordance with the rules established by Hunt County and the TCEQ. Design shall be based on the results of a site evaluation performed on each lot.
22. Only one single-family residence or duplex shall be located on a lot when an on-site sewage facility is used and only one residence shall be connected to said facility.
23. Houses to be built on lots which are lower than the road or roads on which they front and/or abut shall be built such that the minimum finished floor elevation is at least 1-foot above the proposed grade of the yard adjacent to the house. This is to reduce the risk of damage to houses that may be caused by storm water drainage.
24. No Houses shall be built in a 100-years flood plain unless the minimum recommended finished floor elevation is complied with. In no case shall the minimum finished floor elevation be less than 1-foot above the 100-year floor plain elevation.
25. Any filling or obstruction of the floodway or drainage easement is prohibited.
26. Any driveway culverts, if necessary, are to be installed by the property owner and in accordance with the policies of Hunt County and shall be of sufficient size to pass the 5-year storm. In no case shall a driveway culvert be less than 15-inches in diameter on a proposed road.
27. The driveway above a culvert should be constructed such that the driveway is at least six (6”) inches below the outside edge of the main roadway. This will reduce the risk of water, which exceeds the capacity of the culvert flowing over the culvert and entering the roadway.
28. Any underground utility company shall be contacted to verify depth and location of utilities prior to any excavation occurring on the lot.
29. No structure shall be placed any closer that fifteen (15) feet from any property line.
30. Any or all fences installed must be well maintained and painted black after installation. Fences must be made of metal with metal post and must not be placed in any water drainage area. No fence shall exceed five (5) feet in height. Resident must maintain and mow all the property to the edge of any road adjacent to their property.
31. Deed Restrictions shall be enforced by District Court of any property owner of the subdivision.
32. Builder and/or Homeowner will provide a portable dumpster and porta potty during construction and will collect any trash blowing from construction site.
33. Lots must be kept mowed to the height of 6” and free of debris, trash and garbage.
34. All mail boxes must be made from brick or stone like the primary structure.
